Gardener broke a window, does he have to replace it?

Had the yard done, rocky garden, not his fault... rock spat up and hit a window, turning it into a gorgeous spider web effect! it's holding together, for now... just wondering, is he liable for it? he wont answer my calls or return my messages.. he is a local Gardener.
